While regulatory confusion often surrounds these equipment items, the underlying principle is clear: CE marking is not retroactive. A machine built prior to this date that lacks original CE marking does not require a new certification unless substantial modifications are made that alter it structurally or functionally into a &#8220;new&#8221; machine.<\/p>\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-vivid-cyan-blue-color has-text-color has-link-color wp-elements-1\"><div class=\"attachment-container unknown\">&#13;\n<div class=\"text-box-container ng-star-inserted\" data-test-id=\"text-box-container\">&#13;\n<div class=\"text-box-content\">&#13;\n<div class=\"text-box-text gds-headline-s\" dir=\"auto\" data-test-id=\"text-box-text\"><strong>COMPLIANCE WITH ANNEX V OF LEGISLATIVE DECREE 81\/08<\/strong><\/div><br\/><\/div><br\/><\/div><br\/><\/div><\/h3>\n\n<p class=\"wp-block-paragraph\">This does not mean that this equipment can operate without restrictions. The governing legal framework remains Italian Legislative Decree 81\/08 (the Consolidated Act on Health and Safety at Work), which establishes a mandatory obligation to comply with the minimum safety requirements set out in Annex V.
