Directive 2006\/42\/EC is replaced by the new regulation, which does not require national transposition by each Member States, but becomes <strong>directly applicable<\/strong> within the EU area.<\/p>\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#085f9b\"><strong>GOALS AND PURPOSES<\/strong><\/h2>\n\n<p>Machinery Regulation (EU) 2023\/1230<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201clays down health and safety requirements for the design and construction of machinery, related products and partly completed machinery to allow them to be made available on the market or put into service while ensuring a high level of protection of the health and safety of persons, in particular consumers and professional users [&#8230;]\u201d<\/em>.<\/p>\n<\/blockquote>\n\n<p>Specifically, it is intended to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>harmonize safety and health protection requirements<\/strong> for machinery in all member States,<\/li>\n\n\n\n<li><strong>establish<\/strong> <strong>clear rules<\/strong>, which must be applied uniformly by all operators in the EU and leave no scope for divergence in implementation by member States,<\/li>\n\n\n\n<li><strong>identify economic operators<\/strong> (manufacturer, authorised representative, importer, distributor) and their <strong>tasks and responsibilities<\/strong>, as set out in <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019R1020&amp;qid=1688481600428\" target=\"_blank\" rel=\"noopener\">Regulation (EU) 2019\/1020<\/a> on market surveillance and compliance of products,<\/li>\n\n\n\n<li><strong>fill gaps or inconsistencies<\/strong> in the product coverage and conformity assessment procedures of Directive 2006\/42\/EC, with a focus on <strong>emerging technologies<\/strong> (Artificial Intelligence systems, Internet of Things, collaborative robots, etc.)<\/li>\n<\/ul>\n\n<div style=\"height:13px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#085f9b\"><strong>SCOPE OF APPLICATION<\/strong><\/h2>\n\n<p>The Machinery Regulation applies to:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>machines and related products<\/strong> (interchangeable equipment, safety components, lifting accessories, chains, ropes and webbing, removable mechanical transmission devices)<\/li>\n\n\n\n<li><strong>partly completed machinery<\/strong><\/li>\n\n\n\n<li><strong>software<\/strong> designed for the specific application intended by the manufacturer and which are covered by the conformity assessment procedure for machines, and software with a <em>safety function<\/em> (considered as safety components)<\/li>\n\n\n\n<li><strong>on-road vehicles<\/strong> that are not yet covered by a specific legal act of the Union, including electric bicycles, electric scooters and other personal mobility devices.<\/li>\n<\/ul>\n\n<div style=\"height:13px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#085f9b\"><strong>TIMELINE OF IMPLEMENTATION<\/strong><\/h2>\n\n<p>The regulation enters into force on the 20th day after publication in the Official Journal of the European Union and becomes applicable <strong>42 months<\/strong> after the date of entry into force (January 14, 2027).
