Annex V on Pre-1996 Machinery: Regulations, Obligations, and Safety Requirements

22 September 2026

Machinery manufactured before September 21, 1996, commonly referred to as “pre-CE,” still accounts for a significant portion of Italy’s industrial machinery. While regulatory confusion often surrounds these equipment items, the underlying principle is clear: CE marking is not retroactive. A machine built prior to this date that lacks original CE marking does not require a new certification unless substantial modifications are made that alter it structurally or functionally into a “new” machine.

This does not mean that this equipment can operate without restrictions. The governing legal framework remains Italian Legislative Decree 81/08 (the Consolidated Act on Health and Safety at Work), which establishes a mandatory obligation to comply with the minimum safety requirements set out in Annex V. Employers—as well as anyone selling, renting, or leasing pre-CE machinery—bear the legal responsibility of ensuring that the equipment protects the health and safety of operators.

To demonstrate compliance with safety requirements, the most common and effective practice is to rely on a conformity assessment. One of our technical experts analyzes the machinery, evaluates residual risks, and drafts a sworn expert report certifying compliance with the protections required by law.

We perform voluntary inspections and safety assessments. This technical step is essential not only to eliminate the risk of fines or plant shutdowns, but above all to offer concrete protection to workers and ensure full compliance when selling or operating machinery.
